Wilbur Day has sued the City of New York alleging negligence in apprehending the costumed vigilante Spider-man and complicity in Spider-man’s frequent violation of Fourth Amendment rights.
The Court has allowed the lawsuit to be a class action on behalf of all persons suspected to have been abducted by Spider-man and/or his amazing friends.
